This Agreement, in conjunction with our Privacy Policy, constitutes a legally binding agreement between "Saya Tech Labs Pvt. Ltd.," referred to as "NewsShorts," "We," or "Our," and You, the user of our mobile platform ("App"). We urge you to carefully review and understand these Terms and the Privacy Policy. If you have any questions, please contact us at legal@NewsShorts.in, and we will do our best to address your concerns.
a) "App" refers to the NewsShorts mobile platform available for download on Google Play/AppStore, owned by Us.
b) "AppStore" is the service provided by Apple Inc. and/or its affiliates for downloading the App.
c) "AppStore Terms and Conditions" are the terms and conditions for using the AppStore platform, available at https://www.apple.com/legal/internet-services/itunes/us/terms.html.
d) "Google Play" is the service provided by Google Ireland Limited for downloading the App.
e) "Google Play Terms of Service" are the terms of service for using Google Play, available at https://play.google.com/about/play-terms.html.
f) "Sponsored Content" refers to content separate from regular editorial content on the App, easily identifiable by distinct formatting, such as "Ad", "Powered by," "Sponsored by," and similar terms.
g) "User", "You," or "Your" refers to a person who has accepted this Agreement to download and use the App. Unless otherwise specified, singular terms include the plural, and references to one gender encompass all genders, unless context dictates otherwise. Headings and captions are for convenience and do not interpret the Agreement. References to natural persons include their heirs, executors, and permitted assignees, and references to juristic persons include their affiliates, successors, and permitted assignees, unless context suggests otherwise.
a) Downloading and/or installing the App on your device.
b) Accessing or using the App or its content on any device.
a) You are a natural person of legal age in your jurisdiction and have the capacity to form a binding contract with NewsShorts.
b) You are a juristic person with the legal authorization to enter into this Agreement.
c) You are not legally prohibited from using the App. We strongly advise you not to use the App if you do not fully understand, accept, and agree to this Agreement. Please carefully read these Terms and the Privacy Policy before accepting and becoming bound by them.
The App is designed to offer in-app browsing through an embedded browser, summarizing third-party content for easy access and relevance. The App does not host, display, or transmit third-party content unless we have the necessary licenses or permissions under applicable laws. When you read a summary, you will be provided with a link to the source of that summary, and you acknowledge that we are not responsible for the content or accuracy of third-party sources. The App may include links to other mobile applications and websites. We do not endorse or support these links or the content they provide, and we are not responsible for the accuracy or content of such links.
To access the App, you must register as a User and provide information governed by our Privacy Policy.
Certain Sponsored Content may appear within the App.
While using the App, you agree to:
a) Provide accurate and updated information.
b) Use the App for non-commercial, personal purposes.
c) Not use the App or its content for illegal or prohibited purposes.
d) Not copy, modify, reproduce, or publicly display App content.
e) Not transfer your rights to third parties.
If you are a content provider and your content is shared on the App, you must provide information required by applicable laws to relevant government authorities.
We are not liable for the accuracy, validity, or authenticity of information you disclose to comply with applicable laws.
We may modify or cease providing the App at our discretion, without prior notice. Your continued use of the App constitutes acceptance of the Agreement, including any modifications.
Violating this Agreement may result in legal liability, and it does not confer rights on third parties.
If any provision of this Agreement is unenforceable under applicable law, it does not affect the validity and enforceability of other provisions.
Our choice not to act against a breach of this Agreement does not preclude our legal rights in case of subsequent breaches.
You must download and install the App from Google Play/App Store and update it to continue access.
Use the App in compliance with this Agreement, applicable laws, and accepted practices in your jurisdiction.
For content you create using the App, you grant us a limited, non-exclusive license to use it according to our terms, privacy policy, content regulation policy, and other agreements.
We grant you a limited, non-exclusive, non-transferable right to install and use the App on your Android device. You may make a single archival backup copy.
For third-party content, you must obtain a license from the respective third party, as we do not license such content.
If you are a content provider and your content is shared on the App, you must provide information as required by applicable laws to relevant government authorities. We do not provide legal analysis or judgment on reported content.
(a) belongs to another person without proper authorization;
(b) is defamatory, obscene, pornographic, invasive of another's privacy, including bodily privacy, insulting, harassing based on gender, libelous, racially or ethnically objectionable, related to money laundering or gambling, or otherwise in violation of current laws;
(c) is harmful to children;
(d) infringes upon any patent, trademark, copyright, or other proprietary rights;
(e) violates any current laws;
(f) deceives or misleads the recipient about the origin of the message, or communicates knowingly false or misleading information;
(g) impersonates another individual;
(h) threatens the unity, integrity, defense, security, sovereignty of India, friendly relations with foreign States, public order, or causes incitement to commit a cognizable offense or insults other nations;
(i) contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer resource;
(j) contains false information intended to mislead or harass a person, entity, or agency for financial gain or to cause injury;
(k) displays private areas of individuals, shows individuals in full or partial nudity, depicts individuals engaged in sexual acts or conduct, or involves electronic impersonation, including artificially manipulated images of individuals.
You shall not access the App's content by any means other than through the App, unless expressly permitted in a separate written agreement with NewsShorts.
You shall not redistribute, sublicense, rent, publish, sell, assign, lease, market, transfer, or otherwise make the App or any component or content thereof available to third parties.
You shall not bypass or disable any digital rights management, usage rules, or other security features of the App; remove, alter, or obscure any proprietary notices, including copyright notices, on any part of the App; and shall not use the App in a manner that threatens the integrity, performance, or availability of the App.
(a) reverse engineer, decompile, or extract source code related to the App or any part thereof unless expressly permitted in writing by NewsShorts or required by applicable law;
(b) use any robot, spider, retrieval application, or other device to retrieve or index any portion of the App or its content;
(c) collect information about App users for illegal or unlawful purposes;
(d) create user accounts using automated means or fraudulent pretenses to access the App;
(e) transmit viruses, worms, defects, trojan horses, or any destructive elements through the App;
(f) use the App in a way that could damage, disable, overburden, or harm the servers, networks, computer systems, or resources connected to the App, or interfere with other users' enjoyment of the App;
(g) conduct any form of denial of service (DoS, DDoS) or other harmful attacks on the App, or overload, interfere with, or gain unauthorized access to the App, its parts, or any user accounts;
(h) manipulate headers or identifiers to disguise the source of content transmitted through the App or obtain materials or information not intentionally made available by NewsShorts through the App.
You shall not impersonate another individual or falsely claim affiliation with any person or entity, including NewsShorts' officials, employees, agents, partners, affiliates, dealers, and franchisees.
You can report any breaches of these Terms by contacting Mr. Aashish Srivastava, Grievance Officer at legal@NewsShorts.in, and we will make an effort to address your concern within 15 days.
If you come across any content on the App that falls within the prohibited categories listed in section F(a), you can report such violations of these Terms by
contacting us at legal@NewsShorts.in. Your report should include a screenshot or a link to the infringing post and your reasons for objecting to the content. Your reports of violations will be acknowledged within 24 hours by our Grievance Officer.
Removing the violating content.
Suspending or blocking the violating user's account.
Terminating the violating user's access to the App.
If your reports pertain to violations of section F(a)(k) of these Terms, we will respond with the above actions within 24 hours.
Our team's assessment of complaints related to content shared on the App is limited to determining whether such content violates these Terms or our internal policies and guidelines. Our decision in this regard will be final and binding. We do not conduct legal analyses or judgments on the nature of reported content.
If you object to any action taken by us as per section G, you can communicate your objections to us at legal@NewsShorts.in.
We will review your objections and reserve the right to modify or maintain our decision regarding any complaints against content shared on the App.
(a) You voluntarily uninstall the App from your device.
(b) You knowingly or unknowingly cause a direct or indirect breach, as determined by NewsShorts, of this Agreement in whole or in part, or any applicable laws.
(c) We are legally obligated to do so (e.g., when providing access to the App becomes unlawful).
(d) A third party with whom we provided the App to you has terminated its relationship with us or stopped offering related services to us or you.
(e) Providing the App to you is no longer commercially viable or feasible for us. (NewsShorts may terminate your usage of the App at any time, with or without notice, and may disable your access to the App and/or prevent you from using the App in the future.)
You can terminate your agreement with NewsShorts at any time by discontinuing your access to the App. However, certain obligations under this Agreement will continue to apply even after termination.
Upon termination of your agreement with NewsShorts, the legal rights, obligations, and liabilities that you and NewsShorts have established under this Agreement, or which are expressed to continue indefinitely, shall remain in effect indefinitely.
Your use of the App is and will always be subject to the laws governing copyright, trademark, patent, and trade secret ownership and the use of intellectual property. You agree to abide by these laws and will be solely responsible for any violations and infringements of intellectual property rights resulting from your use of the App. NewsShorts owns and retains all intellectual property rights to the summarized content provided to you through the App, but it does not claim ownership rights to the original sources of information, which are held by the websites linked by the App.
All trademarks, brands, and service marks associated with the App belong exclusively to NewsShorts. NewsShorts owns all copyrights and databases related to the App's content. The content on the App, including tests, reports, text, graphics, logos, icons, and images, is the exclusive property of NewsShorts and other respective owners who have granted NewsShorts the right and license to use such content. These materials are protected by Indian and international copyright laws. Trademarks, service marks, and trade names are the proprietary assets of NewsShorts or other respective owners who have granted NewsShorts the right and license to use these marks. The App and any underlying technology or software used in connection with the App may contain rights held by NewsShorts, its affiliates, or third parties. If you intend to use third-party intellectual property, you may need to obtain permission directly from the owner.
Intellectual property not specifically mentioned as owned by NewsShorts is owned by their respective owners, who have the right to take appropriate actions against any violation, infringement, or passing off.
NewsShorts respects the intellectual property rights of others and disclaims any responsibility for violations of such rights by you.
Our Privacy Policy explains how we handle your personal data and protect your privacy when you use the App. By using the App, you agree that we may use your data as per the Privacy Policy.
You are responsible for maintaining the confidentiality of passwords associated with any device you use to access the App. Therefore, you are solely responsible for all activities occurring on your device. If you detect any unauthorized use of your device, you should notify the relevant authorities promptly.
Your utilization of the App or any of its content is entirely at your own risk, and we shall not be held accountable for any form of damages, whether direct, indirect, incidental, consequential, special, exemplary, punitive, monetary, or any other penalties or liabilities stemming from or connected to your use of the App. If you are dissatisfied with the App, you have the option to terminate your access.
You are responsible for defending, indemnifying, and safeguarding NewsShorts, along with its officers, directors, employees, representatives, and agents, from any claims, actions, demands, liabilities, judgments, and settlements, which may encompass reasonable legal fees. These claims may result from or be alleged to result from either:
(a) Your use of the App; or
(b) Your violation of any rules, regulations, or orders under applicable laws.
You are also liable for any breaches of your obligations under this Agreement and the associated consequences.
The App may be controlled and operated from various countries and may be subject to the laws of the country in which it operates. If you use the App from any location, you are responsible for complying with the local laws applicable to you.
This Agreement is governed by and construed in accordance with the laws of Singapore.
In the case of a dispute ("Dispute") between you and us, the dispute must be first resolved amicably through good faith negotiations between the parties. If no resolution is reached within 30 days from the date the Dispute arises, as notified in writing by one party to the other, either party has the right to refer the Dispute to arbitration by issuing a written "Arbitration Notice" for final resolution in accordance with the provisions outlined in this clause M(3).
Upon issuance of an Arbitration Notice, the Dispute will be referred to a single arbitrator mutually selected by the parties. If an arbitrator is not appointed within 30 days of the Arbitration Notice, either party may refer the matter to the President of the SIAC Court of Arbitration according to the rules of the Singapore International Arbitration Centre ("SIAC Rules") for the appointment of the arbitrator. The arbitration proceedings will be administered by the Singapore International Arbitration Centre and governed by the SIAC Rules, which are considered incorporated by reference in this clause M(4). The arbitration's seat will be in Singapore, and the proceedings will be conducted in English.
The arbitral tribunal's award in a Dispute will be final and binding on the parties, enforceable according to its terms, and documented in writing. Both you and NewsShorts will submit to the award of the arbitral tribunal, which will be enforceable in a competent court of law. The tribunal will also decide on the arbitration proceedings' costs. Before or during arbitration, nothing in this Agreement will prevent either party from seeking interim or injunctive relief from courts with competent jurisdiction.
Both you and NewsShorts agree that any cause of action arising from your use of the App must be initiated within three months from when the cause of action accrues or when you become aware of the facts leading to the cause of action, whichever is later. Otherwise, the cause of action will be permanently barred.
NewsShorts may post notices within the App or send you notifications to your registered email address or telephone number. You will be considered to have received these notices within three days of us sending them. Your continued use of the App after this three-day period will be regarded as your acceptance of the notices sent to you.
The content provided through the App may include technical inaccuracies or typographical errors. NewsShorts reserves the right to make changes or improvements to the App at any time. The information available on the App is provided "as is" and "as available" and without any warranties, whether expressed or implied, to the fullest extent permitted by applicable law. NewsShorts does not guarantee that the content's functions will be uninterrupted or error-free, that defects will be rectified, or that the servers hosting them are free from viruses or other harmful elements. NewsShorts does not commit to updating the materials on the interface. Exclusions from these disclaimers may not apply to you if applicable law prohibits such exclusions. NewsShorts will not be held responsible for any misuse or data theft resulting from your use of the App. By using the App, you explicitly represent and warrant that you will not use the App unless you understand, agree to become a party to, and comply with all the terms outlined in this Agreement. Violating this Agreement may result in legal liabilities for you. Nothing in the Agreement should be interpreted as conferring rights upon any third party or any other individual.
Your interactions and business transactions with providers of Sponsored Content or activity found on or through the App, including payment and delivery of related products or services, and any associated terms, conditions, warranties, or representations, are solely between you and the provider of Sponsored Content. NewsShorts will not be held accountable or liable for any losses or damages incurred as a result of such interactions or the presence of Sponsored Content on the App.
